Right of withdrawal (right of cancellation under the Austrian FAGG)
Consumers within the meaning of section 1 of the Austrian Consumer Protection Act (KSchG) have a right of withdrawal (cancellation) in the case of distance contracts, in accordance with the Austrian Distance and Off-Premises Transactions Act (FAGG). Entrepreneurs within the meaning of section 1 KSchG have no right of withdrawal.
1. Right of withdrawal (section 11 FAGG)
You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day on which you, or a third party named by you who is not the carrier, took possession of the goods. If you ordered several goods in one order which are delivered separately, the period begins on the day on which you, or a third party named by you, took possession of the last item (section 11 para. 2 FAGG).
2. Exercising the right of withdrawal (section 12 FAGG)

of your decision to withdraw from this contract by means of an unequivocal statement (e.g. by post or e-mail).
In addition, you can declare your withdrawal using our online withdrawal function in accordance with Art. 11a of Directive 2011/83/EU (inserted by Directive (EU) 2023/2673):

If you use the online withdrawal function, we will send you confirmation of receipt of your withdrawal, including date and time, on a durable medium (by e-mail) without delay.
You may also use the model withdrawal form set out in Annex I Part B FAGG, but this is not mandatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired, or to use the online withdrawal function in good time (section 12 para. 2 FAGG).
3. Effects of withdrawal (sections 14, 15 FAGG)
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw (section 14 para. 1 FAGG). We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise. In no event will you be charged any fees as a result of such reimbursement.
We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earlier (section 14 FAGG).
You shall send back the goods or hand them over to us without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal to us (section 15 para. 1 FAGG). The deadline is met if you send back the goods before the period of fourteen days has expired.
You will have to bear the direct cost of returning the goods (section 15 para. 2 FAGG). For goods which by their nature cannot normally be returned by post (in particular freight goods such as photovoltaic modules, inverters, storage systems or heat pumps), the direct cost of return is estimated at a maximum of approximately EUR 300 per such item.
You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods (section 15 FAGG). Handling beyond what is necessary for inspection is deemed to have occurred in particular where goods have been mounted, installed, put into operation, connected to a system or filled with operating fluids.

5. Exclusion or early expiry of the right of withdrawal (section 18 FAGG)
There is no right of withdrawal for contracts for the supply of goods made to the customer's specifications or clearly personalised to the consumer's requirements – e.g. cables cut to length or mounting rails cut to size (section 18 para. 1 no. 3 FAGG) – or for goods which, after delivery, are by their nature inseparably mixed or combined with other items (section 18 para. 1 FAGG).
In the case of contracts for services (e.g. assembly or installation work), the right of withdrawal expires where we have begun performance before the end of the withdrawal period on the basis of your express request under section 10 FAGG and your acknowledgement that you will lose your right of withdrawal once the contract has been fully performed, and where the service has been fully performed (section 18 para. 1 no. 1 FAGG). If you have made such a request and withdraw before the service has been fully performed, you must pay us an amount which is in proportion to what has already been provided compared with the full coverage of the contract (section 16 FAGG).
6. General notes on returns
- Please notify us of the return in advance (e.g. by e-mail to office@solarvic.at) so that we can prepare to receive it.
- Please avoid damaging or soiling the goods.
- Where possible, return the goods in their original packaging with all accessories and packaging components.
- If you no longer have the original packaging, please use suitable packaging to provide adequate protection against transport damage.
- Please do not return the goods carriage forward.
- The above notes are not a precondition for the effective exercise of the right of withdrawal.
